General Terms for using the app “Lunea”

1. Scope and Provider

(1) These Terms govern the use of the mobile application “Lunea” (the “App”) by you as a user.

(3) By downloading, installing, or using the App, you accept these Terms in their current version.

2. What the App does

(1) Lunea is a period and cycle tracking app that lets you log menstrual bleeding and cycle days, physical and emotional symptoms, and optional health notes.

(2) The App provides overviews and simple estimates based on your entries (e.g., projected cycles or period start).

(3) The App is not a medical device or certified medical product. It is solely for self-monitoring and documenting your data.

3. No contraceptive reliability / No medical advice

(1) Lunea is not suitable for contraception and offers no contraceptive reliability. Forecasts (e.g., ovulation, fertile days, period start) are estimates and may differ significantly from your actual cycle.

(2) Do not use Lunea as the sole basis for contraception, family-planning decisions, or medical diagnoses/treatments.

(3) The App does not provide medical advice. For questions, complaints, uncertainties, or suspected pregnancy, always consult medical professionals.

(4) The provider accepts no liability for pregnancies, health impacts, or other disadvantages resulting from using the App for contraception, diagnostics, or as a substitute for medical advice.

4. Requirements

(1) You need a compatible device and a current operating system (e.g., iOS or Android).

(2) The App is intended for people aged 16+. Under 16 requires consent of a legal guardian.

(3) You are responsible for keeping your device up to date and using common protections (device code, Face ID, fingerprint, updates).

5. Costs

(1) Lunea can be downloaded and used for free.

(2) Optional paid features or subscriptions (in-app purchases) may be offered. Contents, prices, and terms are shown clearly before purchase.

(3) Billing (where offered) is handled by the respective App Store (Apple App Store / Google Play Store) under their conditions.

6. User duties

(1) You agree not to misuse Lunea, store or distribute unlawful content, or attempt to tamper with or hack the App.

(2) You are responsible for the accuracy and completeness of your entries.

(3) If you create backups or exports, you must store them securely and prevent unauthorized access.

7. Liability

(1) The provider is fully liable for intent, gross negligence, and for injury to life, body, or health.

(2) For slight negligence, the provider is liable only for breaches of essential contractual duties (cardinal duties); liability is then limited to foreseeable, typical damages.

(3) Any further liability is excluded; mandatory legal liability remains unaffected.

(4) No liability in particular if the App is used for contraception, medical decisions are derived from it, or data is incorrect/missing due to technical issues.

8. Changes to the App

(1) The provider may change, limit, or discontinue the App in whole or in part, where reasonable.

(2) There is no claim to specific features or availability.

9. Changes to these Terms

(1) These Terms may be updated for valid reasons (e.g., legal changes, new features) with future effect.

(2) We will inform you of material changes (e.g., in-app or on the website). If you do not object and continue to use the App, the new Terms are deemed accepted.

10. Final provisions

(1) German law applies unless mandatory consumer protection rules of your residence require otherwise.

(2) If any provision is invalid, the remaining provisions remain effective.

Privacy Policy for the app “Lunea”

2. Principles

(1) Protecting your personal data—especially health data—is important. We process personal data only within applicable law.

(2) Lunea stores your tracking data by default locally on your device. We generally do not receive this data unless you actively send it (e.g., for support or manual backups).

3. Data we process

Cycle and symptom data (health data): menstrual details (start, end, intensity), physical and emotional symptoms, voluntary notes.

General app data: app version, device model, OS version, language settings.

Communication data (only if you contact us): email address, message content, attachments (e.g., screenshots, exported files).

4. Purposes

Providing app functions (cycle/symptom tracking, stats, forecasts), improving usability and stability, handling your requests, and possible error analysis/support if you actively send data.

5. Storage location and duration

(1) Cycle and symptom data are stored locally on your device. You can view, edit, or delete them in Lunea (single entries or full data, if the App offers it).

(2) When you uninstall, locally stored data is usually removed. Copies may remain in device backups (e.g., iCloud, Google backups); we cannot access those.

(3) Data you send via email or other channels is stored only as long as needed to process it or as required by law.

6. Sharing with third parties

(1) We do not share cycle and symptom data with third parties while you use them locally.

(2) If you export and forward data, you are responsible for that disclosure.

(3) External service providers (e.g., email providers) are contractually bound to data protection. Further sharing occurs only if legally required or with your explicit consent.

7. Legal bases

Consent (especially for health data), necessity for contract performance (use of app features), and our legitimate interest in a secure, stable, user-friendly app (e.g., error analysis, abuse prevention).

8. Your rights

You have rights to access, rectify, erase, restrict processing, data portability, withdraw consent with future effect, and complain to a data protection authority. Contact: mail@annikacreinecke.de.

9. Data security

(1) Protect your device with a passcode, fingerprint, or Face ID to keep sensitive data safe.

(2) We continuously improve Lunea and follow common security standards. Absolute protection from technical risks (e.g., device loss/theft) cannot be guaranteed.

10. Changes to this Privacy Policy

We may update this Privacy Policy if Lunea evolves or legal requirements change.
